Terms of Service

Please read everything carefully before commissioning me.

General terms

  1. All my prices are base prices, which means it can increase depending on how much detail your character has.

  2. The client (the commissioner) may not profit off of the commissioned artwork.

  3. As the artist I still mantain all and absolute rights to my works. This includes publishing the work on my socials, adding it as a part of my portfolio, etc.

  4. I have the rights to refuse your request if I feel uncomfortable or I am not able to work on it.

  5. My artwork is not allowed as a NFT (Non Fungible Token). I am not interested in partaking in cryptocurrencies and NFTs. My art, wether commissioned, pre-existing or merchandise work, can not be minted into an NFT by commissioner nor anyone else.

  6. Neither commissioner nor anyone else is allowed to use my artwork to train any AI/ML models.

  7. Commissions are not first come, first served and will be selected according to preferences in order to deliver the best outcome for clients.

  8. Depending on the order, it can take up to 1-2 weeks or longer(depends on the art's difficulty and amount). 

  9. Deadlines and rush orders can be arranged with an additional fee, you can set a deadline for rush orders, but a fee of +30 USD will be charged. If you want to skip my entire queue and have your order treated as a high priority, this is possible with an additional fee of +50 USD.

  10. The progress of the commission (sketch with base colors) will be provided through screenshots (with the watermark) for revisions and confirmation. Please make sure to make all necessary modifications at the sketch stage, any changes at later stages (lineart or final artwork) will incur a 25% - 50% fee based on the original order price.

  11. Do not  bombard me with messages pertaining to your order. Constant messaging is considered harassment and you will be blacklisted from future commissions for violating terms of service.

  12. The completed artwork will have a subtle signature that you can't remove and it will be sent to your email in high resolution.

  13. After reading my terms of service, please fill in this form here, DM me through any of my socials or e-mail me with the "Commission Request" subject and with all the necessary details.

  14. If I accept your order, I'll contact you and send the invoice to your Paypal , Email. Once I get the payment, I'll add you to my list of orders in progress.

Correspondence

  • The client is responsible for providing as much detail as they can about the the commission to avoid miscommunication. Any missing details or vague wording is subject to interpretation by the Artist.

  • Both the Artist and Client are responsible for replying to correspondence in a timely manner. The Artist reserves the right to delay work on a commission until a reply is received.

Commercial Use

  • Type 1: 2x price, e.g. promotional material, cover art for music, albums, packaging, use in videogame, use for advertising, does not apply to independent content creators without brand deals to advertise their free work.

  • Type 2: 3x price, e.g. art is the product, like posters, stickers, cards, shirts, phone covers, etc.

What I Draw:

  • NSFW/SFW (Not Safe For Work, Safe For Work)

  • Male/Female/Other Character [Manga style/ Semi-realistic]

  • Furry

  • Fanarts

  • Half mecha

  • Monster/yokai/creature

 

What I don’t Draw:

  • Sci-fi/ Full Mecha

  • Environments/ Landscapes

Cancellation and Refund Policy

1. Artist's Right to Cancel: The Artist may cancel a commission at any time, with or without a valid justification.

2. Handling of Cancellations and Refunds: Cancellations and refunds will be addressed on a case-by-case basis.

3. Unfair Cancellations: Unfair cancellations by the Client, such as canceling an in-progress commission without a valid justification, will not result in a refund.

4. Fair Cancellations: Fair cancellations initiated by the Artist, without a valid justification, will result in a full refund to the Client.

Commission Process

Your commission will progress through these distinct phases:

  1. Payment: Once I get the payment, I'll add you to my list of orders in progress.

  2.  Sketch Phase: In this initial phase, we'll explore rough poses and ideas, giving you the opportunity to provide input and direction.

  3. Lineart Phase: Once the sketch is approved, we'll transition to the lineart phase, where I'll create final, clean lines that serve as the foundation for the artwork.

  4. Rendering Phase: The final phase involves coloring and additional detailing to bring your commission to life. This step ensures that your artwork is polished and ready for delivery. 

  5. After all revisions and confirmations, I will send JPEG or PNG files with watermark and a smaller JPEG/PNG file without watermark for you to post on your social medias.(credit me as the artist)

  6. Clients will receive works-in-progress screenshots at the end of each phase. Clients are expected to correspond to these WIPs and are entitled to make suggestions. The artist will not proceed into the next phase without the client’s approval. Upon approval, the client forfeits their rights to suggest any changes to the work completed during that phase. The Artist reserves the right to decline suggestions.

NOTE: Additional fee will be charge if changes were made during and after both lineart and rendering phase.

Payment

  1. All orders must be paid in advance (100% or 50%) via Paypal after the sketch is decided.

  2. All prices stated are in USD. For bank transfer payments, the total price will be directly converted from USD to MYR.(Malaysians only)

  3. Invoicing: Upon agreement, I will provide you with an invoice that includes payment details, including the payment method, amount, and payment due dates.

Copyright Usage/Ownership rights

  1. Clients may share the completed commission under the condition that they attribute the work to the Artist. Commissions are for personal use only. Clients may not use the commission for commercial purposes.

  2. Clients may not share any WIP’s or incomplete material of the commissions received without the Artist’s consent.

  3. The rights to the characters represented in commissions belong to their respective owners.

  4. The Artist has all rights reserved to the commissioned piece.

  5. Commissioner nor anyone else is allowed to edit, trace, copy, or remove the watermark from the finished product.

  6. You are not allowed to claim my art as your own, even in the case of a paid commission.

  7. Commissions are for personal use only. For commercial use, please specify in the commissions form.

  8. Credits to me (@UoQing) or a link going back to one of my socials must be explicitly given anytime the art is showcased.

Privacy Policy for Commissioned Artwork

  1. Client personal information will not be shared, sold, or used for any other purposes without client consent.

  2. My website may contain links to third-party websites or services. I am not responsible for the content, privacy practices, or policies of these third-party sites. Clients are encouraged to review the privacy policies of third-party websites.

  3. By using my website and submitting information for commission requests, clients consent to this Privacy Policy.

  4. I may update this Privacy Policy as needed. Any changes will be posted on this page.
